  1. Somnath Chatterjee has exactly raised the same points which I've listed earlier.

    (1) Judiciary cannot interfere in the policy matters( Prerogative of executive) under any pretext unless otherwise it infringes on fundamental rights of the citizens

    In short, it's unconstitutional on the part of SC to rule FCFS as wrong policy and substitute with Auction. It's purely an executive matter.

    (2) Even if we consider FCFS as wrong policy, then SC should have cancelled all licenses issued under FCFS right from 2001

    (3) Simply nefarious to rush into the judgment and expecting lower court not to get influenced by this judgment when the same matters are running in the special court. What is the urgency (other than the "holy" retirement of A.K.Ganguly)?Why can't judges wait for the completion of trial in special court which is constituted for this special(2G) purpose?

    Somnath on 2G: Can’t interfere with policy decisions

    If the political establishment is shell-shocked by the 2G verdict that by the Supreme Court’s own admission addressed policy issues, few are saying so in public.

    UPA leaders did not want to play with fire a day before another court decides if home minister P. Chidambaram should be investigated to establish if he had played any role in the telecom scandal.

    BJP leaders familiar with the finer points of law expressed the fear in private that the verdict could have worrying consequences for the separation of powers.

    Foreign investors sounded the alarm and analysts forecast investment worth billions could be lost. Cries of foul play also arose with some of the affected operators saying other players are trying to poach their |customers.

    But few would speak out on the larger issues — barring Somnath Chatterjee, the former Lok Sabha Speaker who had repeatedly spoken out against judicial activism if it threatened to undermine the legislature and the executive.

    Chatterjee, who is also a lawyer, said in response to a question that the Supreme Court could not interfere with the policy decisions, not even in the name of public interest.

    “Trying to appropriate executive powers can be very tempting. Well, the Supreme Court is supreme. But it cannot interfere with executive policies and decisions, even by justifying that larger public interest is involved. It has to be kept in mind that nobody is above the Constitution,’’ Chatterjee told The Telegraph from his Santiniketan residence this afternoon.

    “Unfortunately, such things are happening these days. I cannot support it,’’ the former Speaker added.

    (On Saturday, Chatterjee conveyed to The Telegraph that an earlier version of this article had given rise to a wrong impression. The former Lok Sabha Speaker said he had not said the Supreme Court could not interfere in executive decisions. What he said was confined to policy decisions and he had pointed out that court itself has held that it will not interfere ordinarily with government’s policy decisions nor will it substitute such policy with a policy formulated by the court.)

    The two-judge bench had yesterday cited public interest and larger public good to justify its intervention while conceding that it had been held the court should not “ordinarily interfere with the policy decisions of the government in financial matters”.

    The court had also said that when “it is clearly demonstrated that the policy framed by the state… is contrary to public interest or is violative of the constitutional principles, it is the duty of the court to exercise its jurisdiction in larger public interest”.

    According to Chatterjee, the court’s position raises the question why spectrum licences issued between 2003 and 2008 when the public interest litigation was filed were not cancelled. The 122 licences cancelled yesterday were issued in 2008.

    “Since 2003, licences were issued on a first-come-first served basis. If the apex court is so concerned about public interest, why didn’t it cancel those licences? Why did it act only against those who got them when Raja was telecom minister? If natural resources were being wasted then, why didn’t the Supreme Court take cognisance of that?’’ asked Chatterjee.

    According to the judgment, senior counsel Harish Salve had contended that all licences should be cancelled if the court found that the process violated institutional integrity. But the court did not accept the argument, saying that “those who have got licence between 2001 and 24.9.2007 are not parties to these petitions and legality of the licences granted to them has not been questioned before this court”.

    Chatterjee, however, said: “During the NDA government’s rule, the same first-come-first served policy was used. There was no auction… only selection. But not a single voice was heard….”

    The former Speaker also raised doubts about the Supreme Court’s assertion that its verdict would not influence the ongoing 2G trial in a special court. “This spectrum matter is pending before a CBI court. But the SC is saying its ruling will have no impact on the outcome of the CBI court’s verdict. How can that happen? I have my doubts,’’ he said.

    Chatterjee wondered whether courts had similarly gone beyond their jurisdiction when a ruling was issued to determine the age at which schools can admit children.

    “I don’t know what special qualifications a judge can have to decide what should be the correct age for admitting children to schools… whether it’s three or three and a half. But we are witnessing such things. Can the Supreme Court or high court interfere in this regard? I find their intervention in executive decisions unnecessary,’’ Chatterjee added.

    I feel it's better in the national interest that Chief Justice interfere and put this Judgment on hold or the govt immediately initiates the review petition to save the natural justice.

    Out of all the operators, MTS will get back the spectrum at a cheap price(base price to be assigned by TRAI) since there'll be zero competition for CDMA spectrum.

    I expect neither RCOM nor TATA nor BSNL nor MTNL to bid for CDMA spectrum.

    Now, it's imperative upon TRAI to complete the auction process within the grace period of 4 months in order to avoid trouble for subscribers of prospective re-winning operators of shifting to other operators during interim period.

Countering the private companies’ argument that if the FCFS allocation of spectrum has “resulted in violation of the institutional integrity, then all the licences granted 2001 onwards should be cancelled,” it said those who have got licences between 2001 and September 24, 2007 are not parties in these petitions and their legality has not been questioned before this Court.

    This is exactly where I've lost breath to understand.

    When the entire judgment runs on the theory of 2001's FCFS being faulty, what crappy sense has descended upon them to annul only the licenses granted after Sep 2007???

    When they 've scraped the policy of 2001, why on earth they've not scraped the entire beneficiaries??

    When there's scope for impending judgment to annul one particular policy, why not ask all the beneficiaries to be made part of the case???

    What way pre-2007 beneficiaries different from post-2007 beneficiaries????

    It's ironic to see that when the judgment is passed against favoritism, the judgment itself is a favor for some beneficiaries.

    Is this a judgment????

    In nutshell,

    Why the rush to deliver this foolish judgment???

    Why does A.K.Ganguly not trust his successor??

    Is A.K.Ganguly's personal gratification outweighs the integrity of his institution(Supreme Court)??

    This judgment is going to kill the faith in the judiciary.

    You started with praising the judgment but concluded by slamming the judgment.

    I can understand this duality which I've seen in most of the normal onlookers of this case.

    Judgement runs along the chord which says that TRAI's recommendation is flawed which simply implies that FCFS is a wrong policy.(In that sense, your statement

    So it was only the implementation which was FCFS
    straight away rejects the Judgment)

    If that has to taken, then all licences issued from 2001 must be cancelled without any distinction.

    If we assume that Mr. Raja has done wrong implementation, The CBI has clearly identified the set of licenses which falls in this category.

    Then only those licenses should have been cancelled.

    This judgment looks like childish master yelling at his servants that "all are fired" on some major provaction.

    For this 'non-sense', you don't need judges sitting on the papers for so long. This could have been delivered as soon as Mr. Raja was chargesheeted.

    Are we becoming a foolish judiciary where judgments are driven by media pressure??

    Where is Cheif Justice of India???? Is he sleeping??

    What is his opinion on this non-sense??

    Here is a judgment which neither Judges nor the parties to case could explain to the nation.

  5. This judgement by supreme court is utter non-sense.

    I lost all my faith in Indian judiciary and it has acted in arbitrary manner without any logic.

    It simply shows that SC was shamelessly dancing to the music played by the media.

    I feel this judgement was scripted in haste by Judge A.K.Ganguly to leave some kind of legacy behind him rather than serving meaningful Justice.

    It's pointless to pass this judgement when the trial is going on the special court.

    Why can't judges adopted similar position in this case as they've adopted for P.Chidambaram's case?..... Simply ask the special court to continue the trial and pass the judgement....

    Is it not eating into the functional area of the lower court by the higher court? What kind of legacy is it???

    What is the necessity to rush into judgement ???

    Will they ever be able to bring back this time-space relation if the special court finds later that certain licencees had never violated the terms???....

    There were 2 issues before the SC on this case.

    (1) First Come First Serve(FCFS) Policy

    (2) Wrong implementation of FCFS policy

    This judgement catastrophically fails on both accounts.

    If FCFS is wrong policy, then all the licences from 2001 must have been cancelled.

    If it's wrong implementation then the licences which have not violated the policy should never have been cancelled. MTS, TTSL licences(to name a few) will fall in fair category.

    Further looking at a major picture,

    Judiciary does not have any role in policy matters unless it infringes on fundamental rights of the citizens. It's prerogative of the executive.

    In that sense, it just simply can't rule FCFS policy is wrong.

    This is simply judicial overreach. Let us hope Chief Justice is watching this unconstitutional move by his colleagues.

    In my opinion, I see one and only reason.

    Retirement of Mr. A. K.Ganguly.

    The most respected Judge has lost all his credibility due to this act of personal gratification at the 11th hour.

    For his personal empowerment, he has sabotaged the Indian Judiciary.

    Let us focus on future,

    Let us pray sincerely to God that at least special court judge will be meaningful and work for true Justice and not for his media status.

    Govt. must immediately apply for review petition on this utterly irrational judgement.

    Chief Justice must control his wards to work within their constitutional limits. He must crystal clearly define which are the areas in which Judiciary can pass judgments and the areas in which it should not. If not, balance of power between legislative, judiciary & executive will collapse and eventually democracy falls apart.

    Greatest achievement for the very young operator to cross magic 150 mark.

    MTS is the only one to provide 3G(EVDO) among new operators and that too their coverage is far superior than 3G(HSDPA) coverage of many incumbent operators like Vodafone, Airtel & Idea.

  8. DoT releases another comprehensive regulations on addressing security of telecom networks which supersedes all earlier regulations on the subject.....

    These regulations put entire onus on telecom operators to maintain security of their networks....

  10. Ericsson To Acquire Telcordia For $1.15 Billion

    Ericsson has announced that it will acquire 100 percent of shares in Telcordia, a mobile, broadband and enterprise communications software and services provider, for $1.15 billion (approx. Rs.5130 crore), in an all cash transaction, on a cash and debt-free basis.

    Telcordia India‘s joint venture with Gurgaon based Deepak Talwar Consultants, MNP Interconnection Telecom Solutions India Pvt Ltd (MITS), manages India’s Mobile Number Portability solutions in South and East of India for 11 circles: Kolkata, Karnataka, West Bengal, North East, Tamil Nadu including Chennai, Kerela, Assam, Orissa, Andhra Pradesh, Madhya Pradesh and Bihar. In 2009, Telcordia picked up to pick up upto 74% foreign investment in the mobile number portability venture, and allowed a foreign investment of Rs. 45 crore. MNP Interconnection Telecom Solutions India has a 5 year mandate, as per the license. Telcordia has also been operational in the Indian market since 2006, and lists Tata Teleservices, Idea Cellular, Reliance Communications, Aircel and India’s Department of Telecom as its clients.

    Following the acquisition, around 2,600 Telcordia employees will join Ericsson. The deal is expected to close by Q4 2011 and will come into full effect from Q1 2012. Through the acquisition, Ericsson will be able to leverage Telcordia’s skills and expertise in the field of operations support systems (OSS) and Business support systems (BSS), in addition to its business in North America and other markets and its multi-vendor product portfolio.

    Quite an interesting development.....

    There will be lot of conflict of interests if Ericsson handles MNP in India.

    At least we've a chance to become the first country in the world to introduce the same and the rest of the world will follow suit.

    TDSAT blames govt for DTH portability delay

    New Delhi: In what may come as a surprise, it is the government and not the private DTH operators which is responsible for the lack of interoperability among the various DTH set-top boxes. Further, thanks to inaction on the part of the government and the regulator, private DTH firms have continued to violate the licensing conditions over the past eight years.

    Taking a critical note of the Union government’s functioning in the broadcast sector, the Telecom Disputes Settlement and Appellate Tribunal (TDSAT) has said that due to lack of active policy initiatives by both the information and broadcasting ministry and the sector regulator — Telecom Regulatory Authority of India (Trai) — millions of DTH consumers today have no choice but to become slaves of their respective DTH service providers.

    Besides, all operators have been allowed to violate the DTH licensing conditions.

    The tribunal has given 180 days to the government to clear its stand and take corrective action. Out of these 180 days, Trai will get 120 days to make fresh recommendations and the I&B ministry 60 days to act on them.

    “It must be held that the government has allowed breach of licence conditions to take place,” TDSAT said in its judgment in a case filed by a Chennai-based NGO against the Union government over non-interoperability among the DTH boxes. FE was first to report this last year.

    TDSAT noted that the DTH licensing conditions made it mandatory for all DTH service providers to offer only those set-top boxes which were interoperable, both commercially and technically. However, as the DTH licensing conditions are only for MPEG-2 boxes (offered by Dish TV, Tata Sky and DD Direct Plus) and not for the MPEG-4 boxes (Airtel digital TV, Reliance Big TV, Sun Direct and Videocon D2H), both the I&B ministry and Trai did not act on them and allowed the violations of Clause 7.1 of the DTH licensing conditions.

    In its recent judgment, TDSAT said: “It is a matter of concern that the government (I&B ) took two years and four months to make its comments on the Trai recommendations on interoperability and then sent them back.”

    Commenting on Trai’s role, it said: “It is difficult to comprehend that keeping in view the interest of the consumers, Trai had not been keeping a watch on the websites of the operators. The regulations having been made in this behalf as back as in 2007, it was expected that steps be taken for seeing that its recommendations are implemented. We are of the opinion that Trai should be asked to do so.”

    The tribunal also observed that Trai did not keep a tab on the private DTH companies which failed to inform consumers that their boxes could be obtained in three ways – outright purchase, hire-purchase and rentals — and that consumers could return the boxes in case they wanted to change their DTH operator.

    Interoperability in DTH simply means that a consumer can access the services of any other DTH operator without changing his existing set-top box.

    While the law mandates portability, in practice, none of the six private DTH firms have offered interoperable boxes to their 37 million-plus subscribers

  12. DoT readies big-ticket changes in telecom policy

    The Department of Telecommunications (DoT) is considering sweeping changes in the country’s proposed new telecom policy. The department is planning a complete overhaul of the archaic Indian Telegraph Act.

    Under the new telecom policy, DoT also wants to replace the rollout obligation clause for broadband operators with a new incentive scheme. Other key proposals include re-farming of spectrum with operators for 3G and 4G and setting up of a telecom security council to oversee and audit all issues in this area.

    The internal groups in DoT, set up to look into various aspects of the telecom industry and put together the new telecom policy, have given broad suggestions which will come up for final discussions before a draft policy statement is prepared.

    The key takeaways of the suggestions include a road map, a time frame and broader guidelines to ensure availability of 800 Mhz spectrum by 2014. At present, there is no clear road map on the requirement and availability of spectrum every year, which has forced telcos not to have a long-term plan.

    The new scheme to replace the rollout obligation, a bone of contention between telcos and the government, will have service delivery objectives such as reducing licence fee if the service provider covers a specified area in quicker time.

    In lines with highway construction through the BOT route, a public- private partnership (PPP) model has been mooted for building optic fibre and broadband networks in the country.

    DOT has also mooted a proposal that the government should also develop a mechanism to take equity stakes without controlling interest in companies which have indigenously developed high-quality telecom products but cannot finance them.

    Under the policy of re-farming, while telcos with spectrum have to return it to the government which will then auction it for 3G in case of scarcity, operators will get similar amount of spectrum in another band. The re-farming policy has suggested three different models. One, re-farming spectrum only after the expiry of the current licence, two restrict the licence period and re-farm or three re-farm after the end of the equipment’s life time. Telecom regulator TRAI had suggested re-farming of telcos like Bharti Airtel and Vodafone Essar amongst others which are in 900 band and utilisation of this for 3G.

    Apart from charging licence fees for internet services in order to cash in on their future growth, the proposed policy also suggests the integration of UID and The Mahatma Gandhi National Rural Employement Guarantee Scheme (which guarantees rural employment) with mobile telephony.

    It has been also suggested that there should be a national telecom infrastructure policy, which would specify uniform procedures for land acquisition, uniform taxation regime, extending of subsidies and encourage optimum sharing of towers. It has also suggested that tower infrastructure should be bought in under the Telegraph Act and mobile telecom infrastructure should be declared as “critical infrastructure services”. And there should be a uniform right of way policy across states.

    The internal group has also suggested that telecom services should be treated as public utility and industrial rate of power tariff should be applied. Also 100 per cent utilisation of existing towers should be undertaken before new towers are approved in the same zone.

    The internal groups looking at security issues have suggested that there is a need to make security audit of network mandatory and the setting up of a telecom security council for telecom security assurance, policy definition, auditing, certifications amongst others.

    Dear friend, I didn't least expect such a discourteous comment from such valuable and patriotic brain.

    The current home ministry is functioning under the most threating/difficult environment if you compare it against any other internal securities of the world either past or present.

    After 9/11, the entire war is happening in our neighborhood(Afghanistan and Pakistan) and Pakistan being a friendly country to terrorists, for each and every attack on terrorists in Af-Pak, they try to retaliate in India as means of showing they've not lost the capacity to attack a secured nation.

    26/11 is one such story.....

    Now, after Osama, those threats have multiplied multi-fold......

    It's easy to say that our HMinistry is paranoiac but it's important to note that they've to be paranoiac to deal with much more paranoiac terrorists.

    Even a single success out of 1000 attempts by terrorists will be treated as success for terrorists.

    Even a single failure(999 successes)to prevent out of 1000 attempts by terrorists will be treated as failure for HMinistry.

    It's very important to highlight mistakes/errors in HMinistry but at the same time it's important to keep in mind that we live in relatively safe India when compared to India of 26/11.

    Huge credit must go to current ministry.

    It cant be first.

    I feel Anydata and Micomax modems are RUIM based but not OMH complaint. Means EVDO parameters are picked from Modem memory and not from RUIM.

    They normally come with all possible operators' settings when released in respective geography.

    For example, Micromax(300C) modem comes with all Indian CDMA operators(BSNL,TATA,RCOM & MTS) EVDO settings pre-programmed.

    Suppose, if you take this Micromax(300C) modem to Bangladesh/Pakistan/Indonesia, it may not work with that country's CDMA operator's RUIM since those operators settings are not pre-programmed.

    Bangalore, Jun 6 (PTI) The Reserve Bank of India wants more and more banks to launch services on mobile, its Deputy Governor Shyamala Gopinath said here today.

    Launching Canara Bank''s CanMobile, a mobile banking product, she said RBI has already enabled mobile banking and issued guidelines in this regard.

    "..And we do hope that more and more banks now join in the launch of this product", she said.

    According to Canara Bank''s Chairman and Managing Director S Raman, the product is user-friendly, safe, secure and swift.

    It facilitates customers to conduct transactions on 24X7 basis from anywhere with the use of mobile handset.

    Registered customers of "CanMobile" can now access Canara Bank''s services for balance enquiry, viewing of last five transactions, transfer funds intra-bank and inter-bank through Inter Bank Mobile Payment System (IMPS) provided by National Payments Corporation of India (NPCI).

    At present, the bank does not levy any service charge for funds transfer.

    Customers can daily transfer up to a limit of Rs 50,000 through Java/GPRS enabled mobiles and up to Rs 5,000 through non-Java/non-GPRS enabled mobiles by using Unstructured Supplementary Services Data (USSD)/SMS.

    Mobile banking services work on both Java-based and non-Java based applications, bank officials said.

  16. Wimbledon to be first ever BBC 3D broadcast

    MUMBAI: UK pubcaster The BBC will broadcast live 3D coverage to homes across the UK for the first time, when it broadcasts the men's and ladies' finals of the 2011 Wimbledon Championships tennis Grand Slam via its HD Channel.

    The free-to-air broadcast of the Championships in 3D will be available to anyone who has access to a 3D TV set and to HD channels, regardless of which digital TV provider they use.

    The live 3D coverage of the ladies' and men's finals on 2 July and 3 July will mark the 125th anniversary of the Wimbledon Championships.

    The BBC's coverage is being provided in partnership with the AELTC and Sony Professional. It will also be available in a limited number of cinemas across the UK and the BBC is offering a small number of 3D screenings which will be free to members of the public via bbc.co.uk/showsandtours.

    This is one of a small number of 3DTV editorial experiments the BBC is currently undertaking, on behalf of licence payers.

    Coverage of the Championship Finals will also be available in Standard Definition (SD) on BBC One and in High Definition (HD) on BBC One HD.

    BBC HD and 3D head Danielle Nagler said, "I'm delighted that in this anniversary year we're bringing UK audiences a new way of getting close to the action on Centre Court. I'm sure that 3D will only add to the drama as the world's greatest players compete for the championship."

    BBC Executive Producer, Sport Paul Davies said, "During our 75 years of televising the Wimbledon Championships the BBC has continually broken new ground in broadcasting techniques. This unique 3D transmission is the latest innovation to bring to life all the tension, drama and excitement on one of the most iconic sporting arenas in the world."

    As well as coverage on BBC One, BBC One HD, BBC Two and the BBC HD channel, viewers will be able to follow the championships via BBC Online, who will be streaming all the live action direct to viewers' PCs and offering live text commentaries via the mobile service.

    BBC Red Button will also offer a range of viewing options throughout Wimbledon and with BBC Radio 5 Live providing extensive coverage, interviews and commentary from Wimbledon, there are more ways than ever to follow the excitement and action this year.

    BBC iPlayer will be offering up to two full matches every day of the tournament. Wimbledon will also be available on demand from BBC iPlayer in HD and SD.

    Live 3D coverage of the men's singles final will also be available in a select number of UK cinemas and at BBC Television Centre.

    I want to specifically articulate the point that this entire Baba Ramdev non-sense was hatched by saffron forces.

    Today we've the video of meeting between Ramdev and RSS leaders before his so called "fast" at Delhi.

    I whole-heartedly endorse this eviction. That's best possible thing to do under the circumstances....

    India just can't withstand another Ayodhya or Anti-Godhra......

    @dipanlahiri, I respect your view that path is not important but the goal is. I do have many friends who share this point of view. They feel as long as goal is noble the path doesn't matter.

    But, I strongly object and condemn this school of thought. IMHO, path is more important than goal is. If you've noble path you'll always have a noble goal.

    I can never even in dream endorse the position that people leading life out of black money crying to bring back black money. Just unacceptable.......

    Again, I want to refocus on the real need of the hour.....Drafting of powerful Lokpal bill....Certainly not these crappy things......

    The plan of all political parties is to divide the entire nation straight at the middle by enacting this non-sense.

    CCS clears national intelligence grid

    Six months after its Detailed Project Report (DPR) was circulated to members, the Cabinet Committee on Security (CCS) today finally gave an “in-principle” clearance to the ambitious National Intelligence Grid (Natgrid) project.

    This followed a 90-minute slide presentation by Natgrid CEO Raghu Raman and his team to the CCS at the Prime Minister’s residence. Sources said the thrust was to assuage “concerns” of key stakeholders on issues of privacy and security of the proposed mega database from 21 sources.

    What was also stressed was the fact that instead of just another intelligence-gathering organisation, Natgrid was envisaged as a tool or “technical” solution which will provide uninterrupted access of data to nominated officials of 11 intelligence and investigative agencies.

    The CCS clearance today followed a series of meetings and presentations made by the Natgrid team to stakeholder Ministries and Committee of Secretaries. The Finance Ministry, which had earlier expressed serious reservations on Natgrid, had subsequently given its nod days before the CCS meeting.

    Clearances have been obtained for land for the Natgrid project and for the team to now prepare a report for the Empowered Finance Committee.

    The CCS was told about the 11 layers of “built-in security” features in Natgrid’s architecture and the fact that once operational, it would be one of the most ambitious projects using advance PSP (pervasive security in perpetuity) features (till the grid lasts).

    It’s not clear if the CCS also deliberated on clearances for the NCTC (National Counter Intelligence Centre) since both the projects had been simultaneously announced by Home Minister P Chidambaram following the 26/11 Mumbai attacks.

    The concept proposed by the Home Ministry has been that eventually, Natgrid will subsume into the NCTC, but the discussion paper for the latter, too, is understood to be lying undiscussed with the PMO for almost a year.
