DoT asks Airtel to come clean on licence breach

NEW DELHI: The department of telecom (DoT) has asked Bharti Airtel to explain as to why the company should not be fined for what it termed as violation of internet service license. DoT sources said that the company had been informed of two instances of violation — at Karnal in Haryana and at Erode in Tamil Nadu.

DoT will decide on imposing a financial penalty on the company only after evaluating Bharti Airtel’s response. The maximum penalty that can be imposed for this violation is Rs 50 crore.

The issue relates to two old cases that are yet to be resolved. In the first case, the DoT’s monitoring cell has busted an illegal ILD exchange in Karnal, where it was detected that the ADSL internet connection of 512 kbps was taken from Bharti Airtel.

The second instance relates to its vigilance cell’s findings that an internet operator in Erode was running an illegal service with a 4 Mbps lease line from Bharti Infotel. The company has been asked to explain as to why it failed to detect the misuse of the ADSL connection, DoT sources added.

Earlier this month, the Telecom Commission (TC) had approved the Departement of Telecom’s demand that it be allowed to imposed a financial penalty of a maximum of up to Rs 50 crore on Bharti Airtel for ‘violations in the international long distance (ILD) licence agreement’.

The DoT after examining Bharti Airtel’s reply on the issue and also consulting its technical arm — Telecom Engineering Centre – had approached the commission stating that the company had violated a total of four clauses in its ILD license.

The DoT also told the TC that it had decided to penalise the company only after its vigilance cell had inspected Bharti’s ILD switch. In support of its argument, the DoT has also said that Bharti had failed to submit any approval for operating its VoIP gateway.
